29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about  July 24, 2025 - Dun Huang New York Corporation located at 66 W 39th Street, New York, NY 10018 - Kitchen   a) Employees use hazardous chemicals such as but not limited to So-Kleen Lye drain cleaner containing 100% sodium hydroxide to unclog the kitchen drain. The employer did not develop or implement a written Hazard Communication Program .   NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

The employer did not maintain copies of the SDS for each chemical at the workplace.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR  1910.1200(h)(1):The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  On or about  July 24, 2025 - Dun Huang New York Corporation located at 66 W 39th Street, New York, NY 10018  a)  Employees use hazardous chemicals including So-Kleen Lye drain cleaner containing 100% sodium hydroxide to unclog the kitchen drain without receiving training on the hazards associated with the chemical use. The employer did not provide employees with  training on hazards of the chemicals that they use at work.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

29 CFR  1910.132(a):Employer did not provide personal protective equipment to be used when necessary whenever hazards capable of causing injury or impairment were encountered.  On or about  July 24, 2025 - Dun Huang New York Corporation located at 66 W 39th Street, New York, NY 10018  a) An employee used So-Kleen Lye drain cleaner containing 100% sodium hydroxide to unclog a kitchen drain. The employee was not provided with any eye protection which resulted in injury to the employee's eyes.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19
