29 CFR 1926.62(d)(2)(i): Until the employer performed an employee exposure assessment, as required in 29 CFR 1926.62(d), and documented that the employee(s) performing any of the listed tasks was not exposed above the Permissible Exposure Limit (PEL), the employer did not treat affected employee(s) as if they were exposed above the PEL, and not in excess of ten times the PEL, and did not implement employee protective measures prescribed in 29 CFR 1926.62(d)(2)(v). a) Worksite: On or about July 25, 2025, the employer had not perform an employee exposure assessment, as required in 29 CFR 1926.62(d) of this section, and document that the employee(s) performing demolition tasks were not exposed above the Permissible Exposure Limit (PEL) for lead, and the the employer did not implement employee protective measures prescribed in 29 CFR 1926.62(d)(2)(v). ABATEMENT NOTE: 29 CFR 1926.62(d)(2)(v)(A) thru (F): Until the employer performs an employee exposure assessment as required under paragraph (d) of this section and determines actual employee exposure, the employer shall provide to employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii) and (d)(2)(iv) of this section with interim protection as follows: a. Appropriate respiratory protection in accordance with paragraph (f) of this section. b. Appropriate personal protective clothing and equipment in accordance with paragraph (g) of this section. c. Change areas in accordance with paragraph (i)(2) of this section. d. Hand washing facilities in accordance with paragraph (i)(5) of this section. e. Biological monitoring in accordance with paragraph (j)(1)(i) of this section, to consist of blood sampling and analysis for lead and zinc protoporphyrin levels, and f. Training as required under paragraph (l)(1)(i) of this section regarding 29 CFR 1926.59, Hazard Communication; training as required under paragraph (1)(2)(iii) of this section, regarding use of respirators; and training in accordance with 29 CFR 1926.21, Safety training and education.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift. Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. (a) Worksite: On or about July 25, 2025, the employer did not ensure that an employee working from an aerial lift utilized a fall arrest system as a means of fall protection.
