29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  211 W. Douglas St., Superior CO: On or about July 26, 2025, employees working in a vertical trench 12 feet in depth were not provided a safe way to exit the trench. Equipment such as but not limited to a ladder for entering or exiting the trench was not readily available.

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  211 W. Douglas St., Superior CO:  On or about July 26, 2025, the spoil pile(s) was placed within (approximately) 2 inches of the edge of the excavation. The employer failed to implement measures which guarded against soil, equipment or other materials falling /rolling back into excavation(s). This has the potential to expose employees hazards associated with trench collapse and/or struck by hazards from falling soil or equipment.

Douglas St., Superior CO: On or about July 26, 2025, an inspection of the trench was not conducted by a competent person as needed throughout the shift for evidence of situations that could result in possible cave-ins potentially employees to cave-in hazards and/or struck-by hazards from falling materials.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  On or about July 26, 2025, at a jobsite located at 211 W. Douglas St. in  Superior, CO; the employer did not ensure that cave-in protection was used by employees prepping the foundation of a residential home.  Employees were working in a vertical trench measuring approximately 12 ft. in depth without shoring, benching, or a trench box thus increasing the potential of exposure to hazards created by the unguarded trench
