29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about July 31, 2025, at a residential job site, located at 13019 McCracken Rd., Garfield Heights, OH 44125, the employer failed to ensure that portable ladders that were being used to access the roof were placed at least three feet about the upper landing surface.  Employees were exposed to a fall from height hazard of 15-25 feet at varying levels.

29 CFR  1926.1053(b)(9): The area around the top and/or bottom of (a) ladder(s) was not kept clear:   On or about July 31, 2025, at a residential job site, located at 13019 McCracken Rd., Garfield Heights, OH 44125, the employer failed ensure that portable ladders that were being used to access the roof were clear of debris at the bottom of the ladder.  Employees are exposed to a trip and fall hazard when stepping onto and off of the portable ladders.

29 CFR  1926.1060(a)(1): The employer did not provide a training program for each employee using ladders as necessary, enabling each employee to recognize hazards related to ladders and the procedures to be followed to minimize these hazards:   On or about July 31, 2025, at a residential job site, located at 13019 McCracken Rd., Garfield Heights, OH 44125, the employer failed to ensure employees who were using a portable, multi-purpose ladder to access a roof, were trained in the recognition of potential fall hazards and ladder safety and in an effective means of prevention and protection from such.  Employees were exposed to a fall from height hazard of 15-25 feet at varying levels.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about July 31, 2025, at a residential job site, located at 13019 McCracken Rd., Garfield Heights, OH 44125, the employer failed to ensure employees, who were working on a residential roof of approximately 15-25 feet at varying levels, were protected from a fall from height hazards in that employees were not wearing a personal fall protection harness nor were there any other fall protections in place.   Petolex Roof & Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent Standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1689591, citation number 1, item number 1a and was affirmed as a final order on November 27, 2023, with respect to a workplace located at 2039 W. 30th Street, Cleveland OH 44113.
