29 CFR  1926.602(d):The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 and as referenced by the note contained in 1926.602(d).  a) 4888 Dune Drive, Avalon, NJ - The employer did not ensure that the operator of the Genie rough terrain forklift truck (RTFT) received the adequate training and evaluations in RTFT operations, thus exposing employees to struck-by and caught-in-between hazards. This condition was observed on or about July 31, 2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
