29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes 29 CFR 1910.1200(e)(1)(i)-(ii).  a.) On or about August 5, 2025, the employer did not ensure a written hazard communication program was developed for employees exposed to hazardous chemicals including, but not limited to Car Brite Blue Max (corrosive), Car Brite HD Wheel Cleaner (corrosive), and Car Brite Glass Cleaner (flammable, skin/eye irritant) while cleaning and detailing vehicle exteriors and interiors in the main garage.

29 CFR  1910.1200(f)(6)(ii): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  a.) On or about August 5, 2025, the employer did not ensure a 5-gallon tote containing Car Brite HD Wheel Cleaner (corrosive) was properly labeled in that the container had the hazard statements and precautionary statements for Car Brite Blue Max General Purpose Cleaner (corrosive). The container did not provide the correct general information about the hazards of HD Wheel Cleaner for employees in the main garage cleaning and detailing vehicle exteriors and interiors.

29 CFR  1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a.) On or about August 5, 2025, the employer did not ensure safety data sheets for chemicals such as, but not limited to Car Brite Blue Max (corrosive), Car Brite HD Wheel Cleaner (corrosive), and Car Brite Glass Cleaner (flammable, skin/eye irritant) were available in the workplace for employees in the main garage cleaning and detailing vehicle exteriors and interiors.
