29 CFR  1926.760(a)(1):Employees engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:  (a)The Feldhacker Group, Inc.  dba James Steel at 2301 East Side Drive, Yankton, SD 57078: On or about and at times prior to August 5, 2025, the employer did not ensure employees were protected from fall hazards when installing gutter hangers on the roof of an agricultural building, by use of an appropriate fall protection systems. This condition exposed employees to fall hazards greater than 15 feet.

29 CFR  1926.453(b)(2)(v):A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a)The Feldhacker Group, Inc. dba James Steel at 2301 East Side Drive, Yankton, SD 57078: On or about and at times prior to August 5, 2025, the employer did not ensure employees were protected from fall hazards when using a JLG aerial lift (Model 460SJ Serial Number 0300264761) to access and egress from the roof of an agricultural building in that employees did not utilize personal fall arrest systems when in the basket of the aerial lift. This condition exposed employees to fall hazards.
