29 CFR 1910.266(d)(1)(v):The employer did not assure that each employee wore foot protection, such as heavy-duty logging boots, that were waterproof or water repellant, and/or that covered and provided support to the ankle, and protected the employee from penetration by chain saws: a) 3474 Harmony Rd, Gandeeville, WV: On or about August 7, 2025 and at times prior, an employee performed tree felling operations while wearing non-cut-resistant work boots. The boots did not provide protection against chainsaw penetration, exposing the employee to laceration and amputation hazards. No abatement certification or documentation required.

29 CFR 1910.266(d)(2)(i):The employer did not provide first-aid kits at each work site where trees were being cut, at each active landing, and/or on each employee transport vehicle: a) 3474 Harmony Rd, Gandeeville, WV: On or about August 7, 2025 and at times prior, employees were engaged in tree felling operations in a wooded cutting area where no first aid kit was present. First aid kits were available on a truck at the landing and on the dozer but not at the cutting site, exposing employees to delays in emergency medical response. No abatement certification or documentation required.

29 CFR 1910.266(d)(3)(ii):For each vehicle or machine (equipped with ROPS/FOPS or overhead guards), including any vehicle or machine provided by an employee, the employer did not assure that each employee used the available seat belt while the vehicle or machine was being operated: a) 3474 Harmony Rd, Gandeeville, WV: On or about August 7, 2025 and at times prior, an employee operated a bulldozer equipped with a rollover protective structure (ROPS) without using the available seat belt. The machine was being used on uneven terrain and failure to use the seat belt increases the risk of injury in the event of a sudden jolt or rollover. No abatement certification or documentation required.

29 CFR 1910.266(i)(7)(i):The employer did not assure that each employee, including supervisors, had received first-aid and CPR training meeting at least the requirements specified in Appendix B: a) 3474 Harmony Rd, Gandeeville, WV: On or about August 7, 2025 and at times prior, the employer did not ensure all employees engaged in logging operations had current first aid and CPR training, exposing workers to delayed medical response in the event of injury. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
