29 CFR  1926.451(c)(1)(i): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means, as follows: Guys, ties, and braces shall be installed at locations where horizontal members support both inner and outer legs.  a) On or about August 11, 2025, the employer did not ensure that the tubular welded scaffold adjacent to the exterior wall of a residential home was restrained from tipping prior to employee use, exposing employees to a tipping and fall hazard of approximately 21 feet.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) On or about August 11, 2025, the employer did not conduct adequate inspections of the tubular welded scaffold. Employees were exposed to fall heights greater than 21 ft in that adequate means of guardrails were not being utilized, end caps had not been installed, the scaffold was not tied into the structure and the planks of the scaffold were less than 18 in.  b) On or about August 11, 2025, the employer did not conduct adequate inspections of the carpenters scaffold. Employees were exposed to fall heights greater than 15 ft in that adequate means of guardrails were not being utilized, end caps had not been installed and the planks of the scaffold were less than 18 in.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a) On or about August 11, 2025, employees are exposed to a fall hazard greater than 21 ft while performing masonry work on a residential jobsite on a tubular scaffold without utilizing conventional means of fall protection.  b) On or about August 11, 2025, the employer did not ensure that employees working on the carpenter's scaffold positioned over the roof adjacent to the chimney of a residential home were protected from falling by any form of fall protection. Employees were exposed to a fall hazard of approximately 15 feet 10 inches.
