29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a)424 Delaware Avenue New Castle, DE. 19720): On or about August 11, 2025, The compliance officer determined that the employer did not evaluate whether an employee removing hardened concrete from inside a concrete mixing barrel (e.g., using a hammer) was exposed to respirable silica dust-containing Portland cement, quartz, and calcium magnesium hydroxide-at or above the action level during this task.

29 CFR 1910.1200(a)(1): The employer did not effectively ensure that the information concerning the hazards of all chemicals to which the employees may be exposed to, was transmitted as accomplished by the means of the employer's comprehensive hazard communication programs including labeling and other forms of warning, material safety data sheets and employee training. a) 424 Delaware Avenue New Castle, DE 19720: On or about August 11, 2025, a written hazard communication program was not readily maintained on site or with electronic access for the exposed employee exposed to silica dust which contains quartz. The employee used a hammer to loosen the concrete within the mixing barrel that generated plums of dust.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) 424 Delaware Avenue New Castle, DE 19720: On or about August 11 2025, it was determined by the compliance officer that that their employee was not provided comprehensive technical information and training on hazardous chemicals such as but not limited to Portland cement, Quarts, and Calcium Magnesium Hydroxide that's identified as components that are used in the mixing/batching process along with pulverizing the cement product with a hammer while within the mixing drum.
