29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about August 4, 2025, at an establishment located at 2300 Tower Drive in Kaukauna, Wisconsin; the employer did not ensure that powered industrial truck operators that were operating the Toyota 8FGU15 forklift had been trained and certified to the requirements of section (l) of this standard prior to operating the powered industrial trucks.

29 CFR  1910.1200(e)(1): Written hazard communication program. Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also include the elements identified in sections 1910.1200(e)(i)-1910.1200(e)(ii).  On or about August 12, 2025, at an establishment located at 2300 Tower Drive in Kaukauna, Wisconsin, in the shop; the employer did not develop, implement and maintain a Hazard Communication (HAZCOM) program for hazardous chemicals present and used in the workplace, including but not limited to, stains, vanishes, AllPro lacquer thinner, Butyl Acetate, Startex Denatured Alcohol, Sunnyside denatured alcohol, and Sunnyside paint thinner.   All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program. Key elements include, but are not limited to the following:  1) Safety Data Sheets  2) List of all hazardous chemicals 3) Chemical container labeling  4) Employee information and training

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about August 12, 2025, at the establishment located at 2300 Tower Drive, Wisconsin; the employer did not provide employees information and training on hazardous chemicals in their work areas at the time of their initial assignment. Hazardous chemicals found in the employees' work areas included, but were not limited to, stains, vanishes, AllPro lacquer thinner, Butyl Acetate, Startex Denatured Alcohol, Sunnyside denatured alcohol, and Sunnyside paint thinner.
