29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a.) On or about June 3, 2025, at the Gateway Lofts project, the employer failed to conduct frequent and regular inspections of the job site and equipment. A job-made plywood box, approximately 8 feet wide and 4 feet high, was secured to the forks of a Sunbelt JLG 12054 all-terrain forklift with ratchet straps and used to hoist trash material from the 5th floor of the complex. The lack of inspections allowed this unapproved modification to remain in use, exposing employees to struck-by and crushed-by hazards.

29 CFR 1926.602(c)(1)(ii):No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a.) On or about June 3, 2025, at the Gateway Lofts project, the employer failed to get written approval from the ATF manufacturer in the use of a modified trash hooper made of 2x4's and plywood as the employer removed material from the projects finished rooms in that the employer exposed employees to crushed-by, struck-by hazards from a fabricated trash hooper made of 2x4's and plywood.
