29 CFR  1910.133(a)(3): The employer did not ensure that each affected employee who wore prescription lenses while engaged in operations that involved eye hazards wore eye protection that incorporated the prescription in its design, or wore eye protection that could be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses.  a) Brushy Fork Pad Construction, Southwest Corner. On or about August 7, 2025, a maintenance employee was using a pneumatic die grinder with a 4.5 inch grinding disk to grind down the mushroomed head of a bolt.  The employee was not wearing safety glasses that provided adequate protection while grinding and was exposed to flying debris and struck by hazards.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.243(c)(1): Abrasive wheel(s) were used on portable grinder(s) which were not provided with safety guard(s) meeting the requirements specified in 29 CFR 1910.243(c)(1) through (c)(4)(a):   a) Brushy Fork Pad Construction, Southwest Corner. On or about August 7, 2025, a maintenance employee was using a pneumatic die grinder with a 4.5 inch grinding disk to grind down the mushroomed head of a bolt.  The die grinder did not have a guard attached, exposing the employee to struck by hazards.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees.  a) Brushy Fork Pad Construction, Southwest Corner. On or about August 7, 2025, a maintenance employee was using a pneumatic die grinder with a 4.5 inch grinding disk to grind down the mushroomed head of a bolt.  The tools are rented from the maintenance employee and are not inspected on a regular basis to ensure their safety.
