29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: At the manufacturing facility located at 623 W Clinton Avenue in Seymour, Missouri 65746, on August 26, 2025, and at times prior: Employees were exposed to hearing loss from continuous noise levels higher than 85dBA. Elements of a hearing conservation program triggered by exposures exceeding the Action Level were not implemented. Instance 1: Flatline Sanding Booth - Two employees were exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). Employee 1 - dosimeter dBA level was 62% of the action level (85dBA) and was equivalent to approximately 86.5 dBA. The sampling was performed for 526 minutes during one shift on 09/24/2025. Zero exposure was assumed for all unsampled time periods. Employee 2 - dosimeter dBA level was 104.4% of the action level (85dBA) and was equivalent to approximately 90.3 dBA. The sampling was performed for 526 minutes during one shift on 09/24/2025. Zero exposure was assumed for all unsampled time periods. Instance 2: Flatline Loading System - One employee was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). Employee 3 - dosimeter dBA level was 79.6% of the action level (85dBA) and was equivalent to approximately 88.3 dBA. The sampling was performed for 526 minutes during one shift on 09/24/2025. Zero exposure was assumed for all unsampled time periods. *Action level was adjusted to 86.353dBA to reflect the 8 hours and 45 minutes total time sampled in one work shift.

At the manufacturing facility located at 623 W Clinton Avenue in Seymour, Missouri 65746, on August 26, 2025, and at times prior: Employees were exposed to hearing loss from continuous noise levels higher than 85dBA in where the employer did not conduct a full-shift 8-hour noise evaluation to determine employee exposure. Instances include but are not limited to: Instance 1: Flatline Sanding Booth - Two employees were exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). Employee 1 - dosimeter dBA level was 62% of the action level (85dBA) and was equivalent to approximately 86.5 dBA. The sampling was performed for 526 minutes during one shift on 09/24/2025.
