29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) On or about August 15, 2025; Westside of site; employees working in a trench estimated to be 5 feet deep had no means of egress or exit available while carrying out their assigned duties during the conduit installation. This created a safety risk, as the lack of exits method such as a ladder could hinder quick evacuation in the event of an emergency or collapse.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) On or about August 15, 2025; Westside of site: the employer failed to position the spoil pile the necessary two feet away from the excavation site, thereby exposing employees to a significant risk of engulfment while they carried out their assigned tasks, such as the placement of conduit.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.   a) On or about August 15, 2025; Westside of site: the employer failed to conduct daily inspections of both the work area and the trench, which are critical steps in ensuring worker safety. These inspections are essential to identify and correct potential hazards, such as the risk of cave-ins, which could lead to serious injuries or fatalities.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. 29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) On or about August 15, 2025; Westside of site: employees were actively engaged in the installation of conduits within an unguarded trench that was approximately 5 feet deep. During this process, they faced potential for a cave-in. Proper safety measures should have been in place to abate such hazards such as but not limited to the installation of a trench box.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
