29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a.) David Milano Construction, LLC., 865 E. 44th Street, Erie, PA 16504 - On or about 8/15/25, and at times prior thereto, an employee was in an excavation without a protective system in place. The excavation collapsed while employees were in the excavation repairing a broken sewer line. The excavation was approximately 8 feet deep and had near vertical walls. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. a.) David Milano Construction, LLC, 865 E. 44th Street, Erie, PA 16504 - On or about 8/15/25, and at times prior thereto, a competent person for excavations was not onsite to evaluate and control hazards associated with the excavation operations taking place for broken sewer line. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

David Milano Construction, LLC., 865 E. 44th Street, Erie, PA 16504 - On or about 8/15/25, and at times prior thereto, an employee did not receive training on recognition of unsafe conditions and safe work practices when needing to enter an excavation. In addition, the employee did not have training on the 29 CFR 1926 Subpart P - Trenching and Excavation Standard. The excavation collapsed while an employee was in the excavation repairing a broken sewer line. The excavation was approximately 8 feet deep and had near vertical walls. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
