OSH ACT of 1970 Section (5)(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  (a) On or about August 20, 2025, at 1000 Hannah Road, the employer did not provide for his employees specialized training to deal with an approved aftermarket attachment on the JD Skid Steer 331G, thereby exposing them to struck by hazards encountered in areas with drop-offs or slopes.

29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE), such as, but not limited to, employees doing tasks such as operating heavy equipment without the use of PPE.   (a) On or about August 20, 2025, at 1000 Hannah Road, the employer did not assess the workplace for changes in elevations which could affect the operation of the JD Skid Steer 331G with after market attachment such as  the mulcher, thereby exposing them to struck by hazards.
