OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties. a) On or about August 13, 2025, at GPS coordinate's location 26.42269 N, 81.24770 W, Clewiston, FL 33440, employees were exposed to high heat from direct sunlight during the performance of their job duties, including planting tomatoes and eggplants for 6-7 hours. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 23? to 36? (73? to 97?) with a calculated heat index of 24? to 43? (75? to 109?) while working outdoors performing moderate manual labor and wearing hats, long sleeves, and long pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee experienced a heat stroke during his duties on August 13, 2025, and as a result of the exposure the employee died on August 19, 2025, at the hospital. b) On or about August 27, 2025 at GPS coordinate's location 26.42269 N, 81.24770 W, Clewiston, FL 33440, employees were exposed to high heat from direct sunlight during the performance of their job duties, including weeding for 7 hours. The Wet Bulb Globe Temperature (WBGT) ranged from 29? to 32? (84? to 90?) while working outdoors performing moderate manual labor and wearing hats, long sleeves, and long pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.
