29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Santiago Gallegos, dba JR Gallegos Roofing & Repair, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a repeat serious violation of 29 CFR 1926.501(b)(13) with an abatement date of October 21, 2025.  Citation 1, Item 2, a repeat serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of October 21, 2025.  Citation 2, Item , an other than serious violation of 29 CFR 1926.503(b)(1) with an abatement date of October 21, 2025.  In accordance with 29 CFR 1903.19(d)(1), abatement certification and documentation of abatement is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On or about August 28, 2025, employees conducting roofing activities on a residential structure to include tear-off,  and shingle installation on a 6:12 pitch roof were not protected from falling to the lower level by a personal fall arrest system, or other means of fall protection. This exposed employees to a fall hazard of 12-feet 4-inches to 17-feet 4-inches onto concrete.  Santiago Gallegos DBA JR Gallegos Roofing & Repair was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) , which was contained in OSHA inspection number1724629, citation number 1, item number 2, and was affirmed as a final order on May 21, 2024, with respect to a workplace located at 1209 Adams St, North Chicago, IL 60064.  JR. Gallegos Roofing  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number1686227, citation number 2, item number 1, and was affirmed as a final order on November 20, 2023, with respect to a workplace located at 512 59th St., Kenosha, WI 53140.  JR. Gallegos Roofing  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number1535821, citation number 1, item number 1, and was affirmed as a final order on July 30, 2021, with respect to a workplace located at 8013 100th Ave, Pleasant Prairie, WI 53158.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access, or were not secured:  (a) On or about August 28, 2025, the portable extension ladder being used to access the roof of the structure did not extend at least three feet above the upper landing area and was not secured. This exposed employees accessing and egressing the roof to a fall hazard of 12-feet 4-inches.  JR Gallegos Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard  1926.1053(b)(1), which was contained in OSHA inspection number1535821, citation number 1, item number 3, and was affirmed as a final order on July 30, 2021, with respect to a workplace located at 8013 100th Ave, Pleasant Prairie, WI 53158.
