29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On September 3rd, 2025, employees engaged in mason operations located at 109 Scott Road, Papillion, Nebraska 68046, were exposed to struck-by hazards in that employees were observed working on the 3rd tier of scaffolding unloading material while there was an employee working directly below them on the 2nd tier of the scaffolding. The employee on the 2nd tier of the scaffolding was cutting brick and was not wearing a protective helmet.

For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  On or about September 3rd, 2025, employees engaged in mason operations located at 109 Scott Road, Papillion, Nebraska 68046, were exposed to struck-by hazards in that the employer failed to install toe boards on all tiers of the fabricated scaffolding. Employees were observed working on all tiers of the scaffolding.

Crossbraces were used as a means of access.  On or about September 3rd, 2025, employees engaged in mason operations located at 109 Scott Road, Papillion, Nebraska 68046, were exposed to slips and falls in that employees were climbing up and down on cross braces of the scaffolding as well as multiple employees were observed climbing on the side of the vertical poles of the fabricated scaffolding. Both methods required the employees to step up and/or down more than 2 feet between steps.
