29 CFR 1910.147(c)(1) as required by 1960.8(b): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) 538 Tower Rd, Ithaca, NY 14853, on or about 9/11/2025; The employer permitted servicing and maintenance activities on equipment and the facility without establishing a lockout/logout program inclusive of written energy control procedures, employee training, and periodic inspections, to prevent serious injuries from the unexpected energizing, start up, or release of stored energy. Abatement certification is required.

29 CFR 1910.253(b)(4)(iii) as required by 1960.8(b): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour: a) Room G-25, 538 Tower Rd, Ithaca, NY 14853, on or about 9/11/2025; Compressed gas cylinder storage area had one oxygen cylinder stored within 3' of an acetylene cylinder when not in use. The USDA, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.253(b)(4)(iii), which was contained in OSHA inspection number 1607510, citation number 01, item number 003 and was affirmed as a final order on 11/21/2022, with respect to a workplace located at 1.5 miles W of Highway 396, Deadman Creek Rd., June lake, CA 93529. The USDA, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.253(b)(4)(iii), which was contained in OSHA inspection number 1707767 citation number 01 item number 003 and was affirmed as a final order on 2/9/2024, with respect to a workplace located at 18050 Mulock Rd., Challenge, CA 95925.
