29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On or about September 19, 2025, at the residential construction jobsite, an employee was working at height without fall protection while installing decking on the upper level of a new home under construction.  Alvaro Reyna was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1566373, citation number 2, Item number 1 and was affirmed as a final order on 1/19/2022 with respect to a workplace located at 23915 Cotton Grass Trail, Cypress, TX, 77433.  Alvaro Reyna was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1526270, citation number 1, Item number 1 and was affirmed as a final order on 6/18/2021 with respect to a workplace located at 19714 San Angelo Park Dr., Cypress, TX, 77433.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.   On or about September 19, 2025,  at the residential construction jobsite, an employee was using a ladder to access the upper level of a new home under construction. The ladder did not extend at least three feet above the roof landing. The employee was installing decking on the new home.  Alvaro Reyna was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1526270, citation number 1, Item number 2 and was affirmed as a final order on 6/18/2021 with respect to a workplace located at 19714 San Angelo Park Dr., Cypress, TX, 77433.
