29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about 09/28/2025, the employer failed to ensure that a competent person conducted frequent and regular inspections of the job site. At the time of the inspection, at least eight employees were performing roofing activities such as replacing shingles on a steep-slope commercial building without adequate utilization of a fall protection system, and ladders used for roof access did not extend at least three feet above the landing surface. As a result, employees were exposed to a fall hazard of approximately 12 feet on a roof with a 6/12 pitch

29 CFR  1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.   a) On or about 09/28/2025, the employer did not ensure that employees performing roofing activities such as replacing shingles on a steep-slope commercial building were utilizing a fall protection system. Employees were exposed to a fall hazard of 12 feet on a slope that was on a 6/12 pitch.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) On or about 09/28/2025, at 370 Paxton Avenue, Cincinnati, Ohio, 45209, the employer did not ensure that portable ladders used by employees for roofing activities extended at least 3 feet (0.9 m) above the upper landing surface. The ladders were not secured at the top nor equipped with a grasping device, exposing employees to a potential fall hazard of approximately 12 feet.

29 CFR  1926.503(b)(1):The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  a) On or about 09/28/2025, the employer did not ensure that written certification of training records for fall protection were being maintained in that the employer did not have training records for employees working at 370 Paxton Avenue, Cincinnati, Ohio, 45209.
