29 CFR 1910.269(a)(3)(ii)(A):  The contract employer did not ensure that each of its employees was instructed in the hazardous conditions relevant to the employee's work that the contract employer was aware of as a result of information communicated to the contract employer by the host employer under paragraph(a)(3)(i) of this section:  At the worksite located at 2438 Brighton Avenue, Kansas City, Missouri:  Employees were exposed to electrical shock hazards on October 8, 2026.  The employer did not ensure that employees conducting line clearance tree trimming work near overhead powerlines were aware of which powerlines were energized and which powerlines had been de-energized. An employee was electrocuted when a tree limb that they were removing contacted an energized overhead powerline.

29 CFR 1910.269(c)(3)(ii):  Additional job briefings were not held when significant changes occurred during the course of the work, affecting the safety of the employees.    At the worksite located at 2438 Brighton Avenue, Kansas City, Missouri:  Employees were exposed to electrical shock hazards on October 8, 2026.  The employer did not conduct an additional job brief when the scope of work changed to include de-energizing the secondary power line.

29 CFR 1910.269(r)(1)(iv):  Branches that are contacting exposed energized conductors or equipment or that are within the distances specified in Table R-5, Table R-6, Table R-7, and Table R-8 may be removed only through the use of insulating equipment.  At the worksite located at 2438 Brighton Avenue, Kansas City, Missouri:  Employees were exposed to electrical shock hazards on October 8, 2026, when performing tree trimming activities near an energized powerline without the use of insulating equipment, such as but not limited to the hand saw.
