29 CFR  1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a) On or about October 24, 2025,  at 1020 Western Drive, Hartford, WI 53027, the employer did not ensure employees working from elevated heights, while assembling fan motors and electrical harnesses on a Pro Smoker 'N' Roasters, where protected from falling to the lower level.  This exposed employees to fall hazards approximately eight (8) feet in height from the top of an assembled smoker to the concrete surface below.

And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.   (a)  On or about October 24, 2025, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work. Pro Smoker Smokehouse employees were tasked with working from heights, while assembling fan motors and wiring harnesses on a Pro Smoker 'N' Roaster.  The employer did not ensure they were trained on what heights fall protection was required.
