29 CFR 1926.20(b)(1): A safety and health program was not initiated and maintained to provide compliance with the general safety and health provisions of the standard: a) On or about September 25, 2025, at the workplace located at 128 Loon Court, Daytona Beach, FL 32114: The employer failed to develop and/or implement a heat illness prevention program with policy, hazard assessment and work rules. Employees were exposed to the hazard of high heat from direct sun during the performance of their job duties, including lifting, carrying and laying cinder blocks on a new residential building. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 28?- 35? (73? to 95?) and a calculated heat index of 25?-38? (76 ? to 100?) while working outdoors for approximately 8 hours performing moderate to heavy manual labor and wearing long pants, boots, long sleeve shirts, hard hats and gloves. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a) On or about September 25, 2025, at the workplace located at 128 Loon Court, Daytona Beach, FL 32114: The employer did not train employees in the recognition and avoidance of heat related hazards.
