29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a - 29 Butternut Drive, Berlin NJ: Three company worksite workers were exposed to fall hazards, in excess of 21 feet 9 inches to the ground below, while working and walking from a residential structure's partially sheathed pitched roof trusses and while sliding down the exterior surfaces of the pitched roof trusses while wearing full body harnesses whose connected lanyard's were not attached to anchors. b - 29 Butternut Drive, Berlin NJ: A company worksite worker was exposed to fall hazards, in excess of 21 feet 9 inches to the ground below, while working and walking from a residential structure's second floor, exterior wall top plates while wearing a full body harness that was not connected to an anchor with a lanyard or other approved means. c - 29 Butternut Drive, Berlin NJ: A company worker was exposed to fall hazards, in excess of 12 feet 1 inch to the ground below, when walking and working from a residential structure garage exterior wall top plates while not using fall protection. Condition observed on or about 11/14/25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level: a - 29 Butternut Drive, Berlin NJ: Two company worksite workers were exposed to fall hazards, in excess of 21 feet 9 inches to the ground below, while working and walking from a residential structure's partially sheathed pitched roof trusses while wearing full body harnesses whose connected lanyard's other ends ran through a window opening, beneath them, and having extended lengths these lanyards would not have stopped these workers from contacting a lower level had they fallen. Condition observed on or about 11/14/25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a - 29 Butternut Drive, Berlin NJ: Company worksite workers were exposed to falls, up to and in excess of 25 feet, when either improperly utilizing fall protection equipment or when not using fall protection while sheathing a new residential structure's exterior and roof trusses. These worksite workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). Condition noted on or about 11/14/25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
