29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At the shop area, employees engaged in paint spraying activities are required to use a 3M half facepiece respirators were exposed to respiratory hazards in that a written respiratory protection program had not been developed and implemented. Employees utilizes chemicals such as but not limited to: Basecoat White Grey Transparent, Primer Pro Gray and Finish 1 Acrylic Primer which are flammable, causes serious eye damage, may cause drowsiness and can cause eye and skin irritation.

29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. Employees are exposed to pulmonary hazards and/or cardiac stress hazards when using employer required respirators without having been provided a medical evaluation prior to use. The employer requires employees engaged in painting activities to wear 3M half-face respirators when spray painting vehicle parts without having been provided medical evaluations prior to respirator use.
