(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  a) On or about December 4, 2025, and at times prior,  the employer did not ensure that employees installing roofing in the assembly area were protected from falling by providing a fall protection system. As a result, employees were exposed to a fall hazard of greater than 10 feet while building sheds in the shop.

29 CFR  1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  a) On or about December 4, 2025, the employer failed to ensure that each employee exposed to fall hazards were trained on the hazards of falling and the procedures to minimize the hazards in the work area. As a result, employees were exposed to fall hazards greater than 10 feet while assembling barn sheds in the assembly area.

29 CFR  1910.36(g)(1): The ceiling of an exit route must be at least seven feet six inches (2.3 m) high. Any projection from the ceiling must not reach a point less than six feet eight inches (2.0 m) from the floor.  a) On or about December 4, 2025, the exit route traveling through the upstairs offices and/or conference room had a ceiling height of approximately 5 feet 11 inches. The condition impeded safe evacuation in the event of an emergency and exposed employees to a struck against hazard.

Scaffolds used in general industry must meet the requirements in 29 CFR part 1926, subpart L (Scaffolds).  29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) On or about December 4, 2025, the employer did not ensure the baker scaffolds used in the shed assembly area were inspected before each work shift and prior to use.
