OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/Collapse hazards from an unsupported gin pole during demolition of a communication tower.  (a) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure. The gin pole failed as the antenna was attempted to be lowered fatally striking an employee on or about 12/05/2025.   (b) 1825 Murray Ave, Atlantic City, NJ 08401: Employees were removing a 50 foot tall antenna structure utilizing a 68 foot tall Tower Equipment Co PT21 gin pole that was erected and secured to a 300 foot tall AM Blu Knox communication tower structure. The gin pole was secured to the communication tower using nylon slings which were not protected or padded against abrasion. The gin pole failed as the antenna was attempted to be lowered fatally striking an employee on or about 12/05/2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
