29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a.) On or about December 8, 2025, located within the construction of the Paragon Ranch condominium's the employer failed to ensure that a regular and frequent inspection was completed by a competent person in that the employer failed to detect the all-terrain forklift was not equipped with a rigging hook, that all nylon rigging straps were inspected daily and before each use, and that the rigging straps were used against a sharp surface or were not protected from the sharp surface. As a result the employer exposed employees to struck-by/crushed-by hazards from losing the load off an all-terrain forklift and failed rigging that was used incorrectly.

29 CFR 1926.251(a)(6):"Inspections." Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service. a.) On or about December 8, 2025, the employer failed to ensure that nylon rigging straps were inspected before use. Employees were rigging and hoisting a street light post at the Paragon Ranch condominium construction site, using a nylon endless sling that had not been inspected that day or before each lift. As a result, employees were exposed to struck?by hazards from the potential failure of an uninspected rigging strap.

On or about December 8, 2025, the employer failed to ensure that nylon rigging straps were protected from contact with sharp edges. Employees were rigging and hoisting a street light post at the Paragon Ranch condominium construction site by placing an endless nylon sling directly over the unprotected fork of an all?terrain forklift, which created a sharp edge against the webbing as the load was lifted and positioned. As a result, employees were exposed to struck?by hazards from the potential failure of the nylon rigging strap.
