29 CFR  1926.1101(f)(2)(ii): Where a negative exposure assessment had not been made pursuant to 29 CFR 1926.1101(f)(2)(iii), the initial exposure assessment failed to take into consideration both the monitoring results and all observations, information or calculations which indicate employee exposure to asbestos, including any previous monitoring conducted in the workplace, or of the operations of the employer which indicate the levels of airborne asbestos likely to be encountered on the job:   On or about December 9, 2025, where no negative exposure assessment has been made; the employer failed to conduct an initial exposure assessment pursuant to paragraph (f)(1)(iii) of this section to ensure that employees engaged in asbestos abatement operations were not exposed to levels in excess of the 8-hour Time Weighted Average (TWA) Permissible Exposure Limit (PEL) or the short-term exposure limit (Excursion Limit).

29 CFR 1926.1101(k)(7)(i): Warning signs that demarcated the regulated area were not provided and displayed at such a distance from regulated areas that an employee may read the signs and take necessary protective steps before entering the area marked by the signs:   On or about December 9, 2025, the employer failed to ensure that warning signs were provided and displayed at a distance from the regulated area where asbestos abatement work was performed.
