OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between and/or amputation hazards while operating a press brake with unguarded foot treadle/pedal: (a) Press Brake Area - On or about December 4, 2025, the employer did not ensure that the foot treadle/pedal used to actuate the Chicago Dries & Krump Mfg. Co. press brake, Model 68-C, Serial # L-13413, was provided with a protective cover. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) Press Brake Area - On and before December 4, 2025, employees were exposed to machine hazards associated with moving parts during setup periods of the press brakes, including the Chicago Dries & Krump Mfg. Co. press brake, Model 68-C, Serial # L-13413. The employer did not implement equipment or procedures to isolate the Chicago Dries & Krump Mfg. Co. press brake, Model 68-C, Serial # L-13413, from energy sources [per the 1910.147(d)(3) requirements]. As a result, the remaining applicable energy control elements, involving lock-out/tag-out device application [1910.147(d)(4)], dissipation or residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards. (b) Press Brake Area - On and before December 4, 2025, employees were exposed to machine hazards associated with moving parts during setup periods of the press brakes, including the Accurpress press brake, Model 7606, Serial #11785. The employer did not implement equipment or procedures to isolate the Accurpress press brake, Model 7606, Serial #11785, from energy sources [per the 1910.147(d)(3) requirements]. As a result, the remaining applicable energy control elements, involving lock-out/tag-out device application [1910.147(d)(4)], dissipation or residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards. (c) Press Brake Area - On and before December 11, 2025, employees were exposed to machine hazards associated with moving parts during setup periods of the press brakes, including the Di-acro press brake, Model No: 18-48, S/N: 1-1058. The employer did not implement equipment or procedures to isolate the Di-acro press brake, Model No: 18-48, S/N: 1-1058, from energy sources [per the 1910.147(d)(3) requirements]. As a result, the remaining applicable energy control elements, involving lock-out/tag-out device application [1910.147(d)(4)], dissipation or residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards. (b) Press Brake Area - On and before December 4, 2025, the employee exposed to machine hazards associated with moving parts during setup periods of press brakes, including the Accurpress press brake, Model 7606, Serial #11785, was not trained as an authorized user under the lockout tagout program, and was not trained to de-energize machines during setup. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Press Brake Area - On or about December 4, 2025, one or more methods of machine guarding was not provided to protect machine operators from hazards while operating the Chicago Dries & Krump Mfg. Co. press brake, Model 68-C, Serial # L-13413. The area between the stationary die and tooling installed on the ram of the press brake created caught-between hazards for the machine operator when loading the workpiece to be punched. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification.
