OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:  (a) On or about and at times prior to September 5, 2025, at 2900 South 108th Street in West Allis, WI 53227, employees were exposed to crushing hazards when loading/unloading and working around the two Interlake Mecalux pallet racking, used to store doughnut materials, located in the back room which had deflected horizontal member of .75 inches in excess of the manufacturers allowable limit of 0.53 inches of deflection within a 8 foot span.

29 CFR  1910.263(e)(1)(i): Mixers with external power application shall have all belts, chains, gears, pulleys, sprockets, clutches, and other moving parts completely enclosed.   (a) On or about December 12, 2025, and at times prior, the Krispy Kreme icer (Model: 60237 - KK HAND ICER, Serial: 1645) had an exposed rotating coupler, exposing employees to a caught-in hazard while performing doughnut decoration tasks.  The Krispy Kreme Doughnut Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.263(e)(1)(i), which was contained in OSHA inspection number 1768930, citation number 1, item number 10 and was affirmed as a final order on February 24, 2025, with respect to a workplace located at 2900 South 108th Street, West Allis, WI 53227.

29 CFR  1910.303(g)(2)(i):Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):  (a) On or about December 12, 2025, the employer had not ensured live exposed wires for the 120-volt heater of the Krispy Kreme icer (Model: 60237 - KK HAND ICER, Serial: 1645) were guarded. This exposed doughnut decorators to an electric shock hazard while operating the on/off switches.  The Krispy Kreme Doughnut Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.303(g)(2)(i), which was contained in OSHA inspection number 1768930, citation number 1, item number 11 and was affirmed as a final order on February 24, 2025, with respect to a workplace located at 2900 South 108th Street, West Allis, WI 53227.
