29 CFR  1910.178(l)(5): The employer did not evaluate the competency of the operator who had previously received training appropriate to the truck and working conditions encountered.   On or about December 10, 2025, and before at the worksite located at 2229 NE Town Center BLVD, Lee Summit, MO 64064: Employees were exposed to struck by and crushed by hazards while operating forklifts. Employees were operating forklifts to move materials throughout the facility. The employer did not verify that employees had adequate training before operating fork trucks in the workplace.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about December 10, 2025, and before at the worksite located at 2229 NE Town Center BLVD, Lee Summit, MO 64064: employees were exposed to chemical products such as but not limited to, Lead-Acid Battery, Wet. Health effects from these products can cause eye, skin, and respiratory irritation/damage. The employer did not develop, implement and/or maintain at the workplace a written hazard communication program.
