29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before an employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Canning Area - On December 8, 2025, the employer did not establish a program that included energy control procedures for employees to follow, employee training, and periodic inspections to protect employees from injury caused by the unexpected energization, start up or release of stored energy when performing set up and servicing/maintenance of equipment, including but not limited to the CODI Canning Machine, File #E503440. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. 29 CFR 1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Canning Area - On December 8, 2025, the employer did not ensure that employees were adequately protected from rotating parts on the end of the equipment, such as the CODI Canning Machine, model #CCL - 45, serial #N936-02-2024. The conveyor area was not equipped with enclosure guards to cover the ingoing nip points on the conveyor portion of the machine. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification.
