OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the forklift:   a) Receiving: On December 16, 2025; an employee was observed operating a Hyundai 30L-9A without the use of a personal restraint system and was exposed to the hazard of being thrown from the forklift in the event that it turns over or tips. Injuries resulting from being thrown from and crushed by the forklift would most likely be permanent.   NOTE: Abatement certification is required for this item.
