29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. (a) At the jobsite - On or about January 14, 2026, the employer exposed employees to safety hazards, in that each employee was not instructed in the recognition and avoidance of unsafe conditions, including, use of portable saws on unstable, unlevel work surfaces, and not wearing protective footwear and protective helmets where site hazards necessitated both.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe that covered the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work when withdrawn from the work automatically and instantly returning to the covering position. (a) At the jobsite - On or about December 19, 2025, the employer exposed employees to a struck-by hazards, in that employees cut wood framing materials with the guard of the DeWalt circular saw held open with a framing pencil which did not allow the guard to retract back in place before and after cutting the materials and exposing the 7-1/4 inch blade.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). (a) On top of the second floor walls - On or about December 19, 2025, the employer exposed employees to a fall hazard, in that employees did not use fall protection while standing and balancing on the top plates of the second floor walls with an 18' fall to ground distance and a 9' fall to second floor deck distance.
