29 CFR 1910.28(b)(2)(i): 29 CFR 1910.28(b)(2)(i): The employer did not ensure that each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by one of the systems listed in 29 CFR 1910.28(b)(2)(i)(A)-(C). On or about December 22, 2025, employees at a commercial worksite located at 1210 South Neosho Boulevard, Neosho, Missouri, worked at elevations greater than four feet above ground level in hoist areas without adequate fall protection measures in place. This condition exposed employees to fall hazards with the potential to cause serious injury or death.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: On or about December 22, 2025, employees at a commercial worksite located at 1210 South Neosho Boulevard, Neosho, Missouri were observed operating forklifts and/or fork trucks without having received proper training. This practice created significant safety hazards - including struck-by and caught-in/between risks - for both the operators themselves and nearby employees working in the vicinity of the equipment.
