29 CFR 1910.106(e)(6)(ii):Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with. a. On or about January 7, 2026, the employer did not ensure that category 3 flammable liquid transfer operations were conducted with bonding between containers when employees were dispensing kerosene from a 5-gallon container into a 5-gallon bucket, thereby exposing employees to fire hazards.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about December 29, 2025, in the production room, the employer failed to ensure that Press Operators were protected from pinch points on the 450 hydraulic press, thereby exposing employees to caught-in hazards. b. On or about January 7, 2026, in the production room, the employer failed to ensure that Press Operators were protected from pinch points on the 500 hydraulic press, thereby exposing employees to caught-in hazards.
