29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  On or about January 6, 2026, during the installation of water and sewer lines for the excavation of a residential home foundation at a worksite located at 21075 Cedar Creek Drive, Strongsville, Ohio, the employer failed to ensure an employee working inside a trench, with a varying depth of approximately 5.2 feet deep to approximately 9 feet deep were protected from cave-ins by an adequate protective system such as a properly designed benching system, trench shield, hydraulic shoring system, or other form of cave-in protection system.  The soil would have been classified as Type "B", cohesive soil.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  On or about January 6, 2026, during the installation of water and sewer lines for the excavation of a residential home foundation at a worksite located at 21075 Cedar Creek Drive, Strongsville, Ohio, the employer failed to ensure employees working inside a trench, with a varying depth of approximately 5.2 feet deep to approximately 9 feet deep and a length greater than 25 feet, were provided with a safe means of egress from the trench such as a stairway, ladder, and/or ramp.  Engineered Construction, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2) which was contained in OSHA inspection number 1518616, citation number 1, item number 2, and was affirmed as a final order on 4/13/2021, with respect to a workplace located at 7821 Hunting Lake Drive, Concord, Ohio.
