29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) 678 Herbertsville Road, Brick NJ 08724: The employer did not ensure that employees were protected from falls.  Employees engaged in residential roof replacement were working on a roof at heights of 20 feet to the ground surface and were not protected from falls by use of a personal fall arrest system or guardrail system. Condition observed on or about 01/06/2026.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) 678 Herbertsville Road, Brick NJ 08724: Workers were exposed to fall hazards, up to and 10 feet to the ground surface below, when accessing to and egressing from a pitched roof using a portable step ladder whose side rails did not extend at least 3 feet above the surface being accessed/egressed. Condition observed on or about 01/06/2026.
