29 CFR  1926.453(b)(2)(v):  A harness with lanyard attached to the boom was not worn by employee(s) working from an aerial lift:  a) Martin Builders Enterprise, LLC,  at worksite located on 5004 White Road, Union Springs, NY 13160.  On or about January 8, 2026, the employer failed to ensure employees working in an aerial lifts were protected from falling by use of personal fall arrest systems.  Martin Builders Enterprise, LLC, 4460 State Route 414, North Rose, New York, 14516, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1820419, citation number 1, item number 1e and was affirmed as a final order on 8/22/2025.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) Martin Builders Enterprise, LLC, at worksite located on 5004 White Road, Union Springs, NY 13160.  On or about January 8, 2026, the employer failed to ensure employees exposed to fall hazards of greater than 6 feet or  more above the next lower level, were protected from falling by use of personal fall arrest systems, safety net systems, or guardrail systems.  Martin Builders Enterprise, LLC, 4460 State Route 414, North Rose, New York, 14516, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1),  which was contained in the following: 1) OSHA Inspection number 1820419, citation number 2, item number 1 and was affirmed as a final order on 8/22/2025. 2) OSHA Inspection number 1740846,  citation number 2, item number 1 and was affirmed as a final order on 9/20/2024. 3) OSHA Inspection number 1730300,  citation number 1, item number 1 and was affirmed as a final order on 6/12/2024. 4) OSHA Inspection number 1665405,  citation number 1, item number 1 and was affirmed as a final order on 10/11/2023.
