29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  39 Bernardston Road, Bernardston, MA: On and before January 13, 2026, the employer had not established an energy control program to protect employees and outside contractors who performed maintenance and servicing activities on company machines, including the Marvel Series 8 Mark III Bandsaw.  *Abatement Notes:  Energy control procedures are required to be documented for all multiple-energy source machines including, but not limited to, the Marvel Series 8 Mark III Bandsaw. Energy control training is required to be documented and provided for all employees who are, or may be, in an area where energy control procedures may be utilized. A periodic inspection shall include the following elements:  - Appointment of an authorized employee to inspect each local procedure for inaccuracies during an actual energy control task - A review by inspector with each authorized employee, of that employee's responsibilities under each energy control procedure they are authorized to use - Certification that the periodic inspections have been performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act
