OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and fall hazards while being elevated in an unsecured basket on a forklift. On or about December 30, 2025, at an establishment located at 200 Summer Street in Clintonville, Wisconsin, in Building 3; employees were exposed to fall hazards of approximately 8 to 12 feet to the concrete surface while working from an unsecured parts basket that was elevated on the forks of an electric Yale forklift. Employees working on the ground surface adjacent to and below the unsecured basket were exposed to struck-by hazards created by the falling basket, tools, and employee in the basket.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline. a) On or about December 30, 2025, at an establishment located at 200 Summer Street in Clintonville, Wisconsin, outside Building 3; employees were exposed to struck-by hazards when an operator got off their forklift and went inside the building. The load engaging means were not fully lowered when the operator got off the vehicle. b) On or about December 30, 2025, at an establishment located at 200 Summer Street in Clintonville, Wisconsin, in Building 3; employees were exposed to struck-by hazards when an operator got off their forklift after the unsecured load fell off the forks. The load engaging means were not fully lowered when the operator got off the vehicle.

On December 30, 2025, an employee was hospitalized for a punctured lung, broken ribs, and fractured pelvis following a work-related incident on the same day. b) On or about January 13, 2026, at an establishment located at 200 Summer Street in Clintonville, Wisconsin; the employer did not provide the Section (F) required injury description for a work-related beyond first aid event. On December 30, 2025, an employee was concussed and provided stitches for a laceration on their head following a work-related incident on the same day.
