29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Black Timber Furniture Company: On or about January 7th, 2026, and at times prior, employees were exposed to chemical hazards from top coats (Sirca6OPU77S15G10: xylene, ethylbenzene, ethyl acetate, and toluene), Hardeners (Sirca 6CTH3: n-butyl acetate, ethyl acetate, alifatic-aromatic polyisocyanate, toluene, butanone, and hexamethylene-di-isocyanate), and finishing aerosols (Sirca 6FPU50TIX: xylene, sec-butyl acetate, n-butyl acetate, ethylbenzene, and ethyl acetate) while wearing tight fitting 3M half-mask, elastomeric respirators with an organic vapors cartridge to perform staining, painting, and finishing of wooden furniture. The employer failed to ensure that employees were medically evaluated prior to respirator use. b) Black Timber Furniture Company: On or about January 7th, 2026, and at times prior, employees were exposed to chemical hazards from top coats (Sirca6OPU77S15G10: xylene, ethylbenzene, ethyl acetate, and toluene), Hardeners (Sirca 6CTH3: n-butyl acetate, ethyl acetate, alifatic-aromatic polyisocyanate, toluene, butanone, and hexamethylene-di-isocyanate), and finishing aerosols (Sirca 6FPU50TIX: xylene, sec-butyl acetate, n-butyl acetate, ethylbenzene, and ethyl acetate) while wearing tight fitting 3M half-mask, elastomeric respirators with an organic vapors cartridge to perform staining, painting, and finishing of wooden furniture. 29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) Black Timber Furniture Company, Spray Room: On or about January 7th, 2026, and at time prior, employees were exposed to chemical hazards while using xylene, ethylbenzene, ethyl acetate, toluene, butanone, and hexamethylene-di-isocyanate in the spray room without a written hazard communication program. b) Black Timber Furniture Company, Spray Room: On or about January 7th, 2026, and at time prior, employees were exposed to chemical hazards while using xylene, ethylbenzene, ethyl acetate, toluene, butanone, and hexamethylene-di-isocyanate in the spray room without training the employees on the hazards associated with the chemicals. c) Black Timber Furniture Company, Spray Room: On or about January 7th, 2026, and at time prior, employees were exposed to chemical hazards while using xylene, ethylbenzene, ethyl acetate, toluene, butanone, and hexamethylene-di-isocyanate in the spray room without maintaining safety data sheets for use and review by the employees working with the chemicals.
