29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) 750 lighthouse Drive, Barnegat, NJ 08005: Employees engaged in framing and sheathing installation and other related activities were exposed to fall hazards, roughly 40 feet to the ground surface below, when walking on and working on the roof level open joists of a multifamily residential structure without the use of fall protection. Condition observed on or about 01/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   (a) 750 lighthouse Drive, Barnegat, NJ 08005: Workers were not utilizing fall protection and were exposed to fall hazards up to 40 feet to ground surface below when performing framing installation and other related activities while not utilizing fall protection at the worksite. Workers have not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). Condition observed on or about 01/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
