29 CFR 1910.1026(l)(1)(iii): Employers shall include chromium (VI) in the hazard communication program established to comply with the HCS (§ 1910.1200). Employers shall ensure that each employee has access to labels on containers of chromium (VI) and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l)(2) of this section:  On or about January 27, 2026, employees were exposed to Chromium (VI) while TIG welding stainless steel and the employer did not ensure employees were trained on the physical and health hazards which include the following:  a. Health hazards associated with Cr(VI) exposure;  b. The location, manner of use and release of Cr(VI);  c. Engineering controls and work practices associated with the employee's job assignment;  d. The purpose, selection and use of respirators and protective clothing;  e. Emergency procedures;  f. Measures employees can take to protect themselves.

29 CFR 1910.1026(l)(2)(i): The employer did not provide training and information to ensure that employees could demonstrate knowledge of 29 CFR 1910.1026, and the purpose and a description of the medical surveillance program:  On or about January 27, 2026, employees were exposed to Chromium (VI) while TIG welding stainless steel and the employer did not ensure:  a. employees were trained on the knowledge of the contents of the Cr(VI) standard; b. employees were trained on the purpose and description of the medical surveillance program required under the Cr(VI) standard; and; c. that a copy of the Cr(VI) standard is readily available to employees without cost.

29 CFR  1910.1026(i)(4)(i): Employees were allowed to consume food or beverages at a worksite where chromium (VI) was present; however, the employer did not ensure that the eating and drinking areas were maintained as free as practicable of chromium (VI):   On or about January 27, 2026, employees TIG welding stainless steel were permitted to store and consume food and beverages at their welding stations.
