On or about January 15, 2026, on the west side of a newly constructed hotel, the employer failed to ensure that control lines, warning lines, or barricades were erected and maintained around the outriggers of an operating hydraulic telescoping crane. As a result  employees entering the unmarked area were exposed to struck?by and crushed?by hazards.

29 CFR  1926.1428(a): The employer of the signal person must ensure that each signal person meets the Qualification Requirements (paragraph (c) of this section) prior to giving any signals. This requirement must be met by using either Option (1) or Option (2) of this section.   a.) On or about January 15, 2026, the employer failed to ensure that employees who were directing or signaling the crane met the qualification requirements of part (c). Specifically, the employer did not ensure that the designated signal persons knew and understood the types of signals to be used and, when hand signals were employed, did not verify that the signal persons knew and understood the Standard Method for hand signals. As a result, unqualified individuals provided crane signals during lifting operations.
