29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about January 29, 2026, with respect to an establishment located at 3446 Witzel Avenue, Oshkosh, Wisconsin, the employer did not ensure that personnel operating a Clark C35LP forklift had been trained to the requirements of section (l) of this standard prior to operating the powered industrial vehicles.

29 CFR  1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  On or about January 29, 2026, at an establishment located at 3446 Witzel Avenue, Oshkosh, Wisconsin, employees were exposed to fire hazards while recovering refrigerants using two condensers powered by a daisy chain of a six-outlet power strip and an extension cord which was plugged into a wall receptacle.

29 CFR  1910.178(a)(6): The user shall see that all nameplates and markings are in place and are maintained in a legible condition.  On or about January 29, 2026, with respect to an establishment located at 3446 Witzel Avenue, Oshkosh, Wisconsin, the employer did not ensure that personnel operating a Clark C35LP forklift had legible nameplates for the forklift and attachment.
